Saratoga County Family Court has a new judge

Saratoga County Family Court has a new judge come this January. Saratoga County assistant District Attorney Jennifer Jensen-Bergan will become the new Family court Judge. Judge Gilbert Abramson quit the bench and then was thrown off the bench by the judicial commission. He was voted out of the position anyway. Thank you (I guess) to the judicial commission, a kin to shooting a dead horse. Will the new judge coming from the District Attorney's Office be an improvement? I hope so. We will be watching Saratoga County family court very closely. I wonder if the new chip fab plant and all the other new companies coming into the area have any idea of the issues we recently had in Saratoga County family court. I know the companies were given tax incentives and so forth to come to the area. I have to wonder though how many of their employees will be unfortunate enough to have to deal with Saratoga County children services(google Julia BB) and/or Saratoga County family court. You would think the local government leaders would have done more then just put in a fresh judge. :/ What gives me pause about the new judge is that she comes from the district attorney's office. Will she ruthlessly prosecute moms and dads? With the lower burden of proof in family court compared to what exists in criminal court she may have a field day. However it could be that her experience prosecuting is actually an asset. It could be she will require more from Saratoga County Children's services then innuendo and drama before families are destroyed. Perhaps she will require Saratoga County children's services to actually prove their cases with fact and logic. We will see and of course we will be watching. A dad's protest for his son

A Dad with joint legal custody tries to "revoke" consent for a DNR on his son that his ex-wife and custodial parent approved. The Dad wanted to make sure his son's right of having both parents involved in no less then "life and death decisions" were being followed. After receiving some help from disability groups and some government officials and researching for several months he found that in fact the law did allow for the noncustodial parent to have input regarding a DNR. The law was weaken to only include noncustodial parents who have "maintained substantial and continuous contact". Even though the law was weakened it did specifically address the noncustodial parent's rights and the doctor's responsibility. Plus the father states that had did in fact have substantial and continuous contact anyway so the doctor should have sought him out before issuing the DNR. After reviewing the laws the father finally requested the doctor to remove a DNR (do not resuscitate) order she had placed on his son without his consent or input. The doctor refused to call the Dad back, even after many calls, emails, faxes and registered letters. The only government body that enforces this particular health law in New York State is the Department of Health - Office of Professional Medical Conduct. OPMC investigations tend to be extremely slow, taking several months to complete. Everything in the investigation is kept confidential to protect the doctor. The OPMC acts as an independent entity and do not "police" doctors per se but will discipline doctors for failing to follow health law. They are also not very responsive to complainants and the Dad my never know what, if anything, this government agency does regarding the complaint. After having little recourse other then petitioning a court to have the doctor obey the health law, a costly and time consuming affair, the Dad decided to take to the streets. Government has eviscerated my power as a Dad

My feeling is the government eviscerated my power as a Dad so they have taken on some of the responsibility. Agree or disagree? There are people who have taken this idea to the extreme and everywhere in-between. It is an interesting concept. On some level I feel this way but it only validates what the government has done. We must resist this temptation. The government has taken that which is not theirs. They will not and can not do as good a job as the real parents. Stay out of my family. Allow me to make the decisions for my family, for my son and my daughter. The government is responsible for their actions and we should call them on it. We are also responsible for our lack of action.

In the "best interest of the child"

You want to do what's in the "best interest of the child"? That sounds great politically who wouldn't love this. It hasn't really worked. It's old style thinking. It's created a broken system producing broken moms, dads and kids. The best interest of the child is to have BOTH parents involved in their lives. We need to revisit family law. We will have "Julia BB" tragedies or "NO HOPE" labels being put on kids when one or both parents are cast aside. Kids deserve to have input from both parents. I know my son and my daughter deserve this. I implore Senator Roy McDonald and Assemblyman Tony Jordan to revisit family law, break the cycle, pull back the veil of secrecy that hides the shame that lurks in family court. You can make it better. When one parent is cast aside, it makes it easier to cast aside the other as well. Just ask Julia BB's parents and grandparents.

Save yourself or fight for your right?

This is a response I gave to the question of "should you protect yourself or fight for the right to be in your kids lives" or put another way "fight for your kids right to have you in their lives". -------- I was told that my ex-wife was going to do everything in her power to make my life hell. I was told by a friend that I should consider "leaving my kids behind" to preserve myself. It makes perfect sense, I can not be there for them, in ANY capacity if I don't take care of myself. I decided to stay involved because I believe there are key years in a child's life that they need a father and will remember forever and you need those years to ensure a solid bond with your kids. I thankfully have a wife that fully supports me and understands that my ex-wife wants to only bring trouble into our lives. She is and has always been adverse to drama. The drama in our house is kept to a minimum. My ex-wife has tried and failed many, many times to create problems. We stick together and that helps but it is not easy. I have had orders of protection against me from my ex-wife. I had an order of protection against me for my kids. Couldn't see them unless I had supervised visits. This went on for a year and three months. They first try to make you lose credibility - well - "if he had an order of protection he must have done something." The judge who originally issued it never even met me nor I was in court to defend myself.��I've had sheriffs come to my door and hand deliver summons etc. At some point you realize its all meant to intimidate you and you start seeing it for what it is - bs. You WILL have people ganging up on you because fathers are an easy target - its not right - its harmful in many ways. Over time my ex-wife lost credibility. 3 hours before I was to drop the kids off to her one day she was taken to MHU (mental health unit) for breaking out her apartment windows. Saratoga County CPS gave her the Okay and she had the kids back at her place the next day.��This is just one example.��The truth tends to "leak out" over time. All I can say is "know yourself" and everything else is bs. For the last four year my kids and I have strengthened our bonds and when my daughter and son tell me they missed me and they love me I know I made the right choice. I know other fathers who have left to preserve themselves. Not every situation is alike some are worse then others and the decision to leave might make sense for them. I considered it but I stayed and I'm glad. I am now trying to stay involved in government elections and petitioning for equal parenting - If we want change we have to bring it, if not for us, for our children.

Election for family court judge - Saratoga County

It might be a little early to talk about this but the judge in the "Julia BB tragedy"(see earlier post) is up for re-election this year. Senator Roy McDonald is proposing an "Autism Bill of Rights". I feel these two are inconsistent. You have a leader proposing some legislation to help the disabled which I applaud but then you have a judge(Gilbert Abramson) in the same party who doesn't seem to know how to handle cases with disabilities(see Julia BB) going for re-election. I'm hoping the GOP supports a better candidate. I think if they don't the voters will. Here is a link to a local group that influenced another election.
